Abstract:Grounded in the technological reality that the dual-drive of blockchain and AI is reshaping the online copyright ecosystem, this paper systematically analyzes the resulting structural governance dilemmas. The core contradiction of technology-empowered online copyright protection lies in how to balance right protection and data value transformation. To address this, the paper proposes to advance the evolution of copyright regime from static rights allocation to dynamic interest balance through the coordination of rule construction, judicial empowerment, and ecological cultivation. Specifically, at the rule level, this study establishes tiered recognition standards for generative AI, and it also introduce and clarify the data sharing mechanisms and the legal validity of smart contracts respectively, thereby providing legal predictability for technological applications. At the judicial level, this paper sets up review standards for technical evidence, constructs a layered presumption of fault principle, and delineates platform responsibility boundaries, thus forming a technology-sensitive litigation ecosystem. At the ecological level, it promotes the construction of national data infrastructure, innovates "programmable IP" business models, and strengthens industry self-discipline, building a multi-stakeholder governance community. Accordingly, this study suggests that future copyright governance should transcend the linear "regulation-response" mindset and shift toward a responsive governance paradigm with dynamic adaptability, thereby ultimately achieving the coordinated development of protection and transformation.
